Hiện nay, việc đăng ký doanh nghiệp tại nhà được nhiều sự quan tâm. Có hai cách có thể đăng ký tại nhà mà không cần đến cơ quan nhà nước để thực hiện thủ tục:
Cách 1: Tự đăng ký kinh doanh qua mạng.
Cách 2: Dịch vụ đăng ký doanh nghiệp tại nhà [hướng dẫn đăng ký qua mạng].
Kể từ ngày 02 tháng 01 năm 2014, Sở Kế hoạch và Đầu tư bắt đầu triển khai Phục vụ Đăng ký doanh nghiệp tại nhà cho doanh nghiệp có nhu cầu đăng ký thành lập mới doanh nghiệp.
Đăng ký doanh nghiệp tại nhà sẽ hỗ trợ doanh nghiệp chuẩn bị đầy đủ hồ sơ đăng ký doanh nghiệp theo quy định mà không cần đến Sở Kế hoạch và Đầu tư. Quy trình và thao tác kỹ thuật để thực hiện dịch vụ này tương tự như Dịch vụ đăng ký kinh doanh qua mạng.
Phục vụ Đăng ký doanh nghiệp tại nhà sẽ cung cấp các dịch vụ sau:
Thứ nhất, tiếp nhận thông tin đăng ký thành lập mới doanh nghiệp, Chi nhánh, Văn phòng, Địa điểm kinh doanh – Loại hình: Doanh nghiệp tư nhân, Công ty TNHH 1 thành viên, Công ty TNHH 2 thành viên trở lên và Công ty Cổ phần tại bất kỳ thời điểm nào [24 giờ/ngày, 7 ngày/tuần] và tại bất kỳ địa điểm nào có kết nối mạng Internet.
Thứ hai, hướng dẫn qua mạng Internet, không nhiều hơn 02 lần, để doanh nghiệp hoàn chỉnh hồ sơ đăng ký thành lập mới doanh nghiệp trong vòng 24 giờ [trừ thứ 7, chủ nhật và ngày nghỉ theo quy định] kể từ khi nhận thông tin đăng ký qua mạng của doanh nghiệp.
Thứ ba, sau khi hồ sơ hoàn chỉnh, doanh nghiệp có thể tự chọn một trong ba hình thức để hoàn thành thủ tục đăng ký doanh nghiệp, cụ thể như sau:
- Ở nhà và sử dụng dịch vụ “Nhận và trả kết quả hồ sơ đăng ký doanh nghiệp tại nhà” do Bưu điện Thành phố Hồ Chí Minh cung cấp.
- Đến Sở Kế hoạch và Đầu tư để nộp hồ sơ và sử dụng dịch vụ “Trả kết quả hồ sơ đăng ký doanh nghiệp tại nhà” do Bưu điện Thành phố Hồ Chí Minh cung cấp.
- Đến Sở Kế hoạch và Đầu tư để nộp hồ sơ và nhận kết quả đăng ký doanh nghiệp trực tiếp.
Thời gian giải quyết hồ sơ: trong vòng 03 ngày làm việc kể từ ngày nhận hồ sơ hợp lệ.
Người thực hiện thủ tục thành lập doanh nghiệp trực tuyến được nộp hồ sơ theo hai phương thức:
Sử dụng chữ ký số công cộng để thực hiện việc đẩy hồ sơ online:
Bước 1: Gửi hồ sơ đăng ký bằng cách tải văn bản điện tử, kê khai thông tin, ký số và thanh toán lệ phí qua mạng điện tử;
Bước 2: Nhận Giấy biên nhận hồ sơ đăng ký doanh nghiệp qua mạng điện tử;
Bước 3: Nếu hồ sơ đủ điều kiện, Phòng Đăng ký kinh doanh gửi thông tin sang cơ quan thuế để tự động tạo mã số doanh nghiệp. Nếu hồ sơ chưa hợp lệ sẽ thông báo qua mạng để doanh nghiệp sửa đổi, bổ sung.
Bước 4: Sau khi có mã số thuế, Phòng Đăng ký kinh doanh cấp Giấy chứng nhận đăng ký doanh nghiệp và thông báo cho doanh nghiệp.
Sử dụng tài khoản đăng ký kinh doanh:
Bước 1: Thực hiện thủ tục cấp tài khoản đăng ký kinh doanh bằng cách tải văn bản điện tử các giấy tờ chứng thực cá nhân và kê khai thông tin;
Bước 2: Sử dụng tài khoản đó để tải văn bản điện tử, kê khai thông tin và xác thực hồ sơ đăng ký doanh nghiệp;
Bước 3: Nhận Giấy biên nhận hồ sơ đăng ký doanh nghiệp qua mạng điện tử;
Bước 4: Nếu hồ sơ đủ điều kiện, Phòng Đăng ký kinh doanh gửi thông tin sang cơ quan thuế để tự động tạo mã số doanh nghiệp. Nếu hồ sơ chưa hợp lệ sẽ thông báo qua mạng để doanh nghiệp sửa đổi, bổ sung;
Bước 5: Sau khi có mã số thuế, Phòng Đăng ký kinh doanh cấp Giấy chứng nhận đăng ký doanh nghiệp và thông báo cho doanh nghiệp;
Bước 6: Sau khi nhận được thông báo về việc cấp Giấy chứng nhận đăng ký doanh nghiệp, người đại diện theo pháp luật nộp một bộ hồ sơ đăng ký doanh nghiệp bằng bản giấy kèm theo Giấy biên nhận hồ sơ đăng ký doanh nghiệp qua mạng điện tử đến Phòng Đăng ký kinh doanh;
Bước 7: Phòng kinh doanh đối chiếu dấu mục và trao Giấy chứng nhận đăng ký doanh nghiệp cho doanh nghiệp nếu nội dung đối chiếu thống nhất.

Kể từ thời điểm 02 tháng 01 năm 2014. Sở Kế hoạch và Đầu tư bắt đầu triển khai Phục vụ Đăng ký doanh nghiệp tại nhà cho doanh nghiệp có nhu cầu đăng ký thành lập mới công ty ở thành phố HCM. Đăng ký doanh nghiệp tại nhà sẽ hỗ trợ các chủ công ty chuẩn bị đầy đủ hồ sơ đăng ký công ty theo đúng pháp luật. Mà không cần đến Sở Kế hoạch & Đầu tư. Quy trình & thao tác kỹ thuật để thực hiện dịch vụ đăng ký này cũng khá giống với Dịch vụ đăng ký kinh doanh qua mạng mà trước đây Sở kế hoạch đã cung cấp cho các chủ công ty từ cuối năm 2000 đến tháng 10 năm 2010.
– Nhận hồ sơ thông tin đăng ký thành lập mới doanh nghiệp, Chi nhánh, Văn phòng, Địa điểm kinh doanh – Loại hình: công ty tư nhân, Cty TNHH 1 thành viên, Công ty TNHH 2 thành viên trở lên và Công ty Cổ phần tại bất kỳ thời gian nào trong tuần [24 giờ/ngày, 7 ngày/tuần]. Và ở bất kỳ địa điểm nào có kết nối mạng Internet
– Chỉ dẫn qua kết nối Internet, không nhiều hơn 2 lần. Để công ty hoàn chỉnh hồ sơ đăng ký thành lập mới công ty trong khoảng 24 giờ [trừ thứ 7, chủ nhật và ngày nghỉ theo quy định]. Kể từ khi cơ quan tiếp nhận thông tin đăng ký qua mạng của doanh nghiệp.
– Sau khi hồ sơ hoàn chỉnh, công ty có thể tự chọn một trong ba loại hình. Để hoàn thành thủ tục đăng ký công ty, cụ thể như dưới đây

+ Đến Sở Kế hoạch & Đầu tư để nộp hồ sơ & nhận kết quả đăng ký công ty trực tiếp
Trong vòng 03 ngày làm việc kể từ ngày nhận hồ sơ hợp lệ.
* Trường hợp doanh nghiệp sử dụng dịch vụ “Nhận & trả kết quả hồ sơ đăng ký doanh nghiệp tại nhà” hay “Trả kết quả hồ sơ đăng ký doanh nghiệp tại nhà” do Bưu điện cung cấp thì thời gian Bưu điện Thành phố phát trả kết quả hồ sơ đăng ký doanh nghiệp tại địa chỉ nhà cho doanh nghiệp là vào ngày thứ ba [trong vòng 03 ngày làm việc] tính từ lúc Sở Kế hoạch & Đầu tư nhận hồ sơ đăng ký doanh nghiệp hợp lệ.
